The Michigan Medical Marijuana Act (MMMA) at MCL §333.26421 et seq. is a topic that is currently providing fits for law enforcement agencies, prosecutors, courts, legislators, lawyers and most importantly the people of the State of Michigan.
The landscape on this topic is undergoing monumental and nearly daily change in terms of both its practical purpose (“treating or alleviating the pain, nausea, and other symptoms associated with a variety of debilitating medical conditions” for the “health and welfare of its citizens”) and how law enforcement approaches the direct and residual issues that have been created. Michigan Medical Marijuana Act
In 2008 a law was passed making possession of certain amounts of marijuana, under specific circumstances, legal. The law is called the “Michigan Medical Marihuana Act” MCL 333.26421and it’s stated purpose is to:
Initiate Legislation to allow under state law the medical use of marihuana; to provide protections for the medical use of marihuana; to provide for a system of registry identification cards for qualifying patients and primary caregivers; to impose a fee for registry application and renewal; to provide for the promulgation of rules; to provide for the administration of this act; to provide for enforcement of this act; to provide for affirmative defenses; and to provide for penalties for violations of this act.
As stated above certain defenses to marijuana charges have been carved out of the statute, and provide for defense lawyers to file motions to establish facts that may allow a court to dismiss charges.
